Commitment to Consumers in the European Union

Version: 1.0 — draft for legal review
Effective date: upon publication on wvds.it

This Commitment is made by EMSR DATA, razvoj programskih rešitev za proizvodnjo, d.o.o., Trg komandanta Staneta 8, 1000 Ljubljana, Slovenia (company registration number 8424403000; VAT ID SI22714090), the sole seller of paid WKL software through the wvds.it online store.

It applies to Consumers — individuals purchasing outside their trade, business, craft or profession. It forms part of our Terms and Conditions of Purchase and applicable product license terms. In case of conflict, this Commitment and more favorable mandatory consumer law prevail.

Our commitments to you

  1. Clear information before purchase. Before payment, we explain the software's main functions, license scope, total price including taxes, system requirements, compatibility, relevant technical restrictions and update terms.
  2. Immediate electronic delivery. After confirmed payment, we provide access to download your purchased software. If delivery fails, contact shop@wvds.it. Your statutory rights concerning failure to supply remain unaffected.
  3. Perpetual license. Your purchase grants a perpetual right to use the purchased licensed version within its agreed scope. Twelve months of contractual updates and ordinary email support are included. Further annual maintenance is optional and renews automatically only if you expressly choose it.
  4. Withdrawal. You generally have 14 days from conclusion of an online contract to withdraw without giving a reason. For digital content supplied immediately without a physical medium, this right is lost only where, before delivery began, you expressly agreed to early supply, acknowledged loss of the withdrawal right, received the required confirmation on a durable medium, and supply actually began. Otherwise, your statutory right remains. You can contact shop@wvds.it or use the online withdrawal function where the right is available.
  5. Statutory conformity rights. If software does not conform to the contract, you may request that it be brought into conformity free of charge and, under the statutory conditions, a price reduction or termination. For a one-off delivery, Slovenian law generally covers a lack of conformity existing at delivery that becomes apparent within two years. We also provide legally required updates, including security updates, for the period required by law. Expiry of the 12-month contractual support period does not remove these rights.
  6. Fair refunds. We do not offer an additional voluntary money-back guarantee, but all statutory refund and other remedies remain available. Following a valid withdrawal, we refund within the statutory period, normally to the original payment method without fees to you.
  7. Complaints. Email shop@wvds.it. EMSR DATA does not voluntarily recognize an ADR body, except where participation is required by law. Your right to seek redress before a court remains intact.
  8. EU consumer protection. Slovenian law governs the contract, but you retain mandatory consumer protections of your country of habitual residence where those protections apply. We do not exclude liability or remedies where doing so would be unlawful.
